Self-Regulation
I. Organize signing of self-regulation agreements and implementation
rules, establish a review and disclosure system on implementation
of the agreements, deal with complaints from both members and
the public, and take self-regulatory measures to urge regulated
operations by members and safeguard a fair market environment
for competition;
II. Establish an industry standard in accordance with the Articles
and regulations, promote and review implementation, and
enhance industry services;
III. Foster a faith system in the banking industry and a credit
information system of banking institutions and employees to strengthen
credit review and assist in construction of a credit system in
banking industry;
IV. Set up codes of conduct and ethics, carry out self-regulatory
administration on banking employees, and organize certification
examinations and training sessions for banking employees in order
to enhance the overall quality of employees.
V. Impose self-regulatory penalties on members that harm the
industry¡¯s interests by violating CBA Articles, self-regulatory
agreements or other regulations, and report to CBRC promptly.
VI. Report complaint promptly to CBRC about violations
of laws or regulations by financial institutions or employees
, and carry out investigation and
settlement of complaints transferred from CBRC.
Rights Protection
I. Set up rights-protection agreements, and take various measures,
including regional credit environment grading, publishing lists
of customers of good and bad faith and joint penalty, to prevent
tortious deeds and safeguard the legal interests of the banking
industry;
II. Take part in the decision making procedures concerning reforms
and development of the banking industry and make suggestions
on relevant policies, legislations and industry planning, etc;
III. Report to CBRC problems hindering reforms and the development
of the banking industry, initiate communication with relevant
organs and try to foster a favorable external environment for
industry development;
IV. Organize rights protection surveys among members,immediately
indicate possible risks to members, and urge them to strengthen
rights protection and risk management.
Reconciliation
I. Authorized by members, reconcile relationship between members
and government, and assist CBRC in implementing relevant policies
and measures;
II. Reconcile relationship among members, foster a settlement
system for disputes within the industry to fairly solve various
disputes and foster a favorable internal environment;
III. Reconcile relationship between members and the public, strengthen
communication between members and the public, and safeguard the
legal interests of members and their clients;
IV. Strengthen communications between members and the press,
set up a system to handle news reports on urgent issues, promptly
steer public opinions and safeguard reputation of the banking
industry.
Services
I. Set up a network system among members, organize communication
and cooperation in areas including expertise, techniques and
information, and provide information services to members;
II. Initiate and maintain communications and cooperation with
overseas banking institutions and banking/bankers/bank associations;
III. Strengthen communication and reconciliation with trade associations
in securities and insurance industries;
IV. Tap overall information dissemination function of the whole
industry, organize members to carry out promotion and inquiries
on new businesses and policies, enhance publicity of financial
knowledge and enhance financial awareness of the public;
V. Organize professional competitions to strengthen understanding
and communications among members and foster a healthy industry
culture.
